This application has been filed seeking to condone the delay of 159 days in re-presenting the written statement.

2.It had been stated that the written statement which had been filed was returned on 02.02.2022 and it was re-presented within the stipulated time i.e., on 09.02.2022. However, it was returned on 10.02.2022, which was represented on 27.06.2022 and the same was again returned on 28.06.2022. The deponent of the affidavit stated that she suffered from ill health. 3.In view of the above reasons, the delay in re-presentation is condoned and this application is allowed. The written statement of the 1st defendant is taken on record.

Post the main suit under the caption the caption 'for framing of issues' on 18.11.2022.
