Petitioner is the complainant. He filed the complaint before the Judicial Magistrate (Fast Track Court), Vellore against the respondent under section 138 of Negotiable Instruments Act. The learned Magistrate after trial, dismissed the complaint. Challenging the same, the complainant has filed the appeal. Since the appeal is against acquittal, he has filed the present Criminal Original Petition for granting special leave to file the appeal.
2. Heard the learned counsel for the petitioner and the learned cousnel for the respondent and perused the grounds of appeal.
3. Execution of the cheque and the signature are admitted and further there are some arguable points in the grounds of appeal. Therefore Leave is granted.
4. Registry is directed to number the appeal if it is otherwise in order and list the matter in the usual course.
