Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents to file current status report regarding the construction of Limited Usage Subway in lieu of Level Crossing No.81 at Vaniyambadi and in event of any delay in obtaining administrative sanction and approvals from the concerned departments for finalising the construction of Limited Usage Subway, take intensive efforts to obtain the same and after getting it commence the construction on war footing and complete it without further delay.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This petition is styled as public interest litigation for direction

to the respondents to file current status report regarding the construction of Limited Usage Subway in lieu of Level Crossing No.81 at Vaniyambadi and in event of any delay in obtaining administrative sanction and approvals from the concerned departments for finalising the construction of Limited Usage Subway, take intensive efforts to obtain the same and after getting it commence the construction on war footing.

2. After going through the contents of the petition, we find that the petitioner desires that this Court should monitor construction of limited usage subway.

3. Learned counsel for the respondent/Railways, on advance copy, would submit that he has instructions to say that process of land acquisition is lying pending with the State Government.

4. In view of the aforesaid statement, we are not inclined to keep this petition pending only for the purpose of monitoring.
