Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a writ of certiorarified mandamus, to call for records of the 2nd Respondent comprised in his proceedings in Se.Mu.No.A3/5707/2023 dated 11.03.2025 and quash the same and consequently directing the 1st to 3rd Respondents herein to restore the patta issued to the Petitioner for the property in Survey No.21/16B2A, measuring an extent of 0.03.72 ares, bearing patta No.486, situated at Allikondapattu Village & Post, Thiruvannamalai Taluk and District. ORDER

This writ petition has been filed seeking to quash the proceedings of the 2nd respondent in Se.Mu.No.A3/5707/2023 dated 11.03.2025 and consequently to direct the 1st to 3rd respondents to restore the patta issued to the petitioner for the property in Survey No.21/16B2A, measuring an extent of 0.03.72 ares, bearing patta No.486, situated at Allikondapattu Village & Post, Tiruvannamalai Taluk and District. 2/5

2.Even though the petitioner has challenged the impugned proceedings, learned counsel for the petitioner would now submit on instructions that since the petitioner has already preferred an appeal as against the impugned proceedings before the 5th respondent, a direction may be issued to the 5th respondent to dispose of the appeal within a time frame to be fixed by this Court.

3.The appeal was filed by the petitioner before the 5th respondent on 19.05.2025. No prejudice would be caused to the respondents if a direction is issued to the 5th respondent to dispose of the petitioner's appeal dated 19.05.2025 within a time frame to be fixed by this Court, after hearing the objections of the 4th respondent and by adhering to the principles of natural justice.

4.This Court is not expressing any opinion on merits of the petitioner's appeal.

5.For the foregoing reasons, this writ petition is disposed of by directing the 5th respondent to dispose of the appeal dated 19.05.2025 filed by the petitioner on merits and in accordance with law after hearing 3/5

the objections of the 4th respondent and by adhering to the principles of natural justice within a period of 12 weeks from the date of receipt of a copy of this order. Consequently, connected miscellaneous petition is closed. No costs.
