Respondent Writ Petition filed under Article 226 of the Constitution of India, seeking for issuance of a Writ of Certiorarified Mandamus, to call for the order dated 01.06.2018 passed by the respondent in No.843/SB.II/2018 and quash the same as illegal and consequently, direct the respondent to grant permission to the petitioner to sit as a single person for one day hunger strike at the Memorial of Dr.Puratchi Thalavi Amma J.Jayalalitha or the Memorial of Dr.Puratchi Thalavar M.G.R. situated at Marine Beach Road, Navalar Nagar, Marina Beach, Triplicane, Chennai, Tamil Nadu 600 005, by fixing a date and time from 08.00 hours to 18.00 hours on that day.

O R D E R

This writ petition has been filed to call for the order dated 01.06.2018 passed by the respondent in No.843/SB.II/2018 and quash the same as illegal and consequently, direct the respondent to grant permission to the petitioner to sit as a single person for one day hunger strike at the Memorial of Dr.Puratchi Thalavi Amma J.Jayalalitha or the Memorial of Dr.Puratchi Thalavar M.G.R. situated at Marine Beach Road, Navalar Nagar, Marina Beach, Triplicane, Chennai, Tamil Nadu 600 005, by fixing a date and time from 08.00 hours to 18.00 hours on that day.

2. It is seen that the petitioner gave a representation on 30.05.2018, for conducting one day fasting in Marina Beach, which was rejected by the Commissioner of Police, Chennai, by order dated 01.06.2018, challenging which, this writ petition has been filed.

3.Since the matter relating to grant of permission to conduct protest in Marina Beach is seized of, by the Division Bench of this Court, the prayer sought for by the petitioner cannot be granted. However, if the petitioner gives a fresh representation seeking permission for conducting one day fasting in any other notified place in Chennai, the same shall be considered in accordance with law.

With the above direction, this petition is closed. No costs.
