The present miscellaneous petition has been filed seeking to condone the delay of 37 days in preferring the Criminal Appeal against the judgment of acquittal passed by the learned Additional District Court Mettupalayam, Coimbatore District in S.C.No.108 of 2014 by an order dated 27.02.2023.

Mr.A.Gopinath, learned Government Advocate (Crl. Side) appearing for the 1st respondent and Mr.C.P.Sivamohan, learned counsel appearing for the 2nd respondent have no objection for this petition being allowed.
3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.
4. Registry is directed to number the Criminal Appeal, if the papers are otherwise in order and list the same for admission.
