Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorarified Mandamus to call for records relevant to the auction sale notice in TIIC/VLR/BO/LAO/2018-19, dated 14.05.2018, passed by the third respondent and to quash the same as illegal improper unreasonable, arbitrary and against the principles of natural justice and thereby, directing the respondent to furnish the true and correct statement of accounts in respect of loan Account No.8113-0082 to the petitioner and consider the petitioner's representation, dated 17.05.2018 for one time settlement.

Heard Mr.B.Sundarapandiyan, the learned counsel appearing for the petitioner and Mr.V.Jayaprakash Narayanan, the learned Special Government Pleader accepting notice on behalf of the respondents. With consent of the learned counsel on either side, the Writ Petition is taken up for disposal.

This Writ Petition has been filed by the petitioner challenging the auction sale notice issued by the third respondent, dated 14.05.2018, calling upon the petitioner to pay and clear the balance outstanding sum of Rs.10,65,000/-, failing which, third respondent proposed to conduct auction in respect of the machinery belonging to the petitioner on 18.06.2018.

3. Since the notice impugned herein was issued a month back, i.e., on 14.05.2018, this Court is not inclined to entertain the Writ Petition. Accordingly, the Writ Petition stands dismissed. No costs.
