ORDER

This Criminal Original Petition has been filed under section 482 of the Code of Criminal Procedure, 1973 praying to direct the respondent herein to register the complaint dated 1.7.2013 alleged to have been given by the petitioner.

2. It is averred in the petition that the petitioner has sent a complaint to the respondent on 1.7.2013, wherein certain corrupt practices of Village President Mrs.Lokeswari have been mentioned. In fact, the said Mrs.Lokeswari has swindled huge amount of public money. Under the said circumstances, the complaint in question has been given to the respondent. But the respondent has not even registered the same and therefore the present Criminal Original Petition has been filed for getting the relief sought for therein.

3. The learned counsel appearing for the petitioner has contended that the said Mrs.Lokeswari has already been removed from https://hcservices.ecourts.gov.in/hcservices/

her post for certain lapses committed by her and even in the complaint dated 1.7.2013, it has been specifically stated to the effect that she has indulged in corrupt activities and thereby defalcated huge amount of public money. But the respondent has not evinced any interest in registering the complaint dated 1.7.2013 and therefore necessary direction may be given to the respondent.

4. The learned Additional Public Prosecutor has represented that the Court can give usual direction to the respondent.

5. It is seen from the records that on the side of the petitioner, certain documents have been filed so as to substantiate the allegations levelled against the said Mrs.Lokeswari. It is an admitted fact that the complaint in question has been given on 1.7.2013, but so far the same has not been registered by the respondent.

6. Considering the gravity of allegations made against Mrs.Lokeswari in the complaint dated 1.7.2013, this Court is of the view to give the following direction to the respondent.

7. In fine, this Criminal Original Petition is allowed. The respondent is strictly directed to look into the complaint dated 1.7.2013 given by the petitioner and proceed further if any cognizable offence is made out.
