PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the respondents police officials to alter the FIR by impleading M.J.Gopal as accused in Crime No.187 of 2019 on the file of the 3rd respondent and make an enquiry and file a additional fresh FIR and to file a final report.

ORDER

This petition has been filed seeking to direct the respondents police officials to alter the FIR by impleading M.J.Gopal as accused in Crime No.187 of 2019 on the file of the 3rd respondent and make an enquiry and file a additional fresh FIR and to file a final report.

2. The learned Additional Public Prosecutor on instructions would submit that the FIR was registered only on 12.06.2019 for an offence under Sections 409, 465, 468 and 471 of IPC. The investigation is in progress. If in the course of investigation, https://hcservices.ecourts.gov.in/hcservices/

the respondent police are able to collect sufficient materials, they will implead M.J.Gopal as accused in the above FIR.

3. In view of the above submission, there shall be a direction to the 3rd respondent to continue the investigation effectively and based on the materials collected during the course of investigation, either alter the FIR or file the final report by showing the necessary offences. All the persons involved in the crime shall also be made as accused persons.

4. This Criminal Original Petition is disposed of with the above direction.
