Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the 2nd respondent herein to consider and disposal of the representation of the petitioner herein dated 06.02.2015 forthwith. For Petitioner :

ORDER

Heard M/s.R.Vinu Priyanka, learned counsel for the petitioner and Mr.M.L.Mahendran, learned Government Advocate appearing for the respondents 1 and 2 and with their consent, the writ petition is disposed of at the admission stage itself. Since the writ petition is disposed of at the admission stage without notice to the

respondents 3 to 6, the merits of the allegations made by the petitioner as against them are not gone into and it is left open to the 2nd respondent to take note of the same.

2.The petitioner seeks for issuance of a writ of mandamus to direct the 2nd respondent herein to consider and disposal of the representation of the petitioner herein dated 06.02.2015 forthwith. 3.The grievance of the petitioner is against his sons-in-law and daughters and others stating that they interfering in the petitioner's right to enjoy his own patta land and his sons-in-law are threatening the petitioner. Already the petitioner had lodged a police complaint and a case has been registered in Cr.No.91/2014 on the file of the Ilavarasanur Kottai Police Station, Villupuram District, for offences u/s.147, 447, 427 IPC. Since the grievance of the petitioner is against the private parties, the only remedy available to the petitioner is to approach the civil court or if there is any cognizable offence made out, then the petitioner has to pursue his complaint.

4.Since already a FIR has been registered, there will be a direction to the Station House Officer, Ilavarasanur Kottai Police Station, Villupuram District, to investigate the case in Cr.No.91/2014, if the same is still pending and file the final report within a period of three weeks from the date of receipt of a copy of this order.

5.With the above direction, the writ petition is disposed of. No costs.
