ORDER

The petitioner is the first accused in Crime No.209 of 2014, on the file of the 1st respondent namely Inspector of Police, Manalurpettai Police Station, Villupuram District, has filed this criminal original petition, to quash the FIR.

2. The learned Additional Public Prosecutor submitted that in this case, the investigation has been completed and charge sheet has been filed on 01.09.2014 in C.C.No.20 of 2018 for the alleged offence under Sections 353, 506(ii) and 379 IPC r/w 4 (1-A) of the Mines and Minerals (Development and Regulation) Act, 1957. She further submitted that there are totally two accused in this case. Petitioner is the first accused.

filed, nothing survives in this criminal original petition and the petitioner is at liberty to raise the objections, before the Trial Court.

4. It is submitted that the case in C.C.No.20 of 2018 unable to proceed further, due to the pendency of the above said criminal original petition. It is made clear that nothing survives in the criminal original petition and the Trial Court is directed to proceed with the trial and dispose of the case, on taking into consideration of the offence is of the year 2014.

5. In view of the above, this criminal original petition is dismissed. Consequently, the connected miscellaneous petition is closed.
