This application is taken out by the 4th defendant who is stated to be the tenant of the property in the suit.

2.In this application, the 4th defendant has averred that he has vacated the premises viz. Item No.1 of the suit property even in the year 2015 and hence his name has to be deleted from the case list and he must be relieved of the burden from participating in the suit.

3.The plaintiff has filed the counter. However, it only reiterates the same fact.

4.This Court now records the statement of the 4th defendant vide this application in A.No.3987 of 2021 and directs deletion of his name. 5.Accordingly, the defendants 5 and 6 are re-ranked and they would be now arrayed as 4th and 5th defendants.

kas 6.The plaintiff though is required to carry out necessary amendment in the plaint, in view of the ongoing restrictions in holding the physical Court but at the same time to ensure that unnecessary time is not lost for carrying out amendment, this Court now directs the Registry to carry out necessary amendment in the plaint.

7.The plaintiff is directed to file amended copy of the plaint for the convenience of the Court.
