The petitioner, who apprehends arrest for the alleged offence under Section 294(b), 323, 324, 506(2) of IPC in Crime No.133 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant is separated from his wife doubting her fidelity, he demanded her to vacate the house, he demanded her to vacate the house, due to which a verbal altercation arose between him and his co-brother namely Suresh. The petitioner along with others came there and assaulted the defacto complainant and she sustained grievous injuries. Hence the complaint.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) would submit that the petitioner along with others came there and assaulted the defacto complainant. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5.Considering the submissions made by the learned counsel on either side, the learned counsel for the petitioner submits that the petitioner is falsely implicated but as per the FIR he was present in the scene of occurrence. The petitioner along with the other accused the defacto complainant due to which she sustained grievous injuries. Therefore, this Court is not inclined to grant Anticipatory bail to the petitioner.
