ORDER
This writ petition has been filed for the following relief: "directing the respondents to pay interest at the rate of 10% for the belated payment of Gratuity, P.G, Leave Surrender Salary and Commutation of Pension Amount to the petitioners."
2. The brief facts which are culminated in the filing of this writ petition are set out below:
2.1. It is the case of the petitioners that they joined the service of the respondent Corporation as drivers and conductors and retired from service on attaining the age of superannuation on different dates. The respondents settled the Provident Fund, Gratuity, Leave Surrender Salary and Commutation, with a delay. Therefore, the respondents are legally bound to pay interest to the petitioners. Hence, the petitioners made representations to the respondents to pay the interest at the rate of 10% p.a., for the belated payment of the petitioners' Provident Fund, Gratuity, Leave Surrender Salary and Commutation. Since there is no response, the petitioners are before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. Admittedly, the Provident Fund, Gratuity, Leave Surrender Salary and Commutation has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petition is disposed of with a direction to the respondents to disburse the 6% interest for belated payment of Provident Fund, Gratuity, Leave Surrender Salary and Commutation, within a period of one (1) month from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition in W.M.P.No.24232 of 2026 is ordered subject to payment of separate Court fee. 22-06-2026 Index: Yes/No Speaking/Non-speaking order rap To
