..Respondent(s) Prayer:- This Petition is filed under Article 226 of the Constitution of India, pleased to issue Writ of Mandamus to direct the respondents herein to give adequate police protection to the petitioner's Kottupakkam Village to conduct the festival to be held on 28.04.2026 to 30.04.2026 without any interference of the Melacherry Villagers, in pursuant to the Decree and judgment of Permanent Injunction granted on 29.04.2009 in O.S.No. 108/2007, Sub Court Cheyyar. ORDER
The petitioner, a resident of Kottupakkam Village submitted a representation on 25.04.2026 stating that Arul Mighu Shree Maariamman Kovil comprised in S.No.55/1, in Kottupakkam village. Festivals are traditionally conducted in these temples during the months of Margazhi and Chitirai. The petitioner earlier filed a Civil Suit in O.S.No.108 of 2007 and obtained an injunction order from the Sub Court, Cheyyar, in their favour to conduct these festivals. This year's festival was scheduled to be held between 28.04.2026 and 30.04.2026. Consequently, the petitioner sought Police protection to conduct the festival on 30.04.2026, without interference from the B party who are residents of Melachery village.
2.The learned Additional Public Prosecutor appearing for the respondents submitted that based on the petitioner's representation, the Tahsildar conducted a Peace Committee Meeting. It was decided that no festival should be conducted from 28.04.2026 to 30.04.2026, as the B party had organised programmes within 100 meters of the site. The counsel for the petitioner submits that B party's functions are scheduled from 23.04.2026 to 13.05.2026. He further submitted that if the petitioner holds the festival on 01.05.2026 instead, the respondent Police will provide adequate protection.
3.Considered the rival submissions and perused the materials available on record.
4.In view of the above, the petitioner is directed to hold the festival on 01.05.2026, without any disturbance or creating law and order problems in their village as well as in the Melachery Village. Accordingly, the respondent Police are directed to provide necessary Police protection to the petitioner's village on 01.05.2026, to conduct the above said festival. 5.With the above directions, this petition is disposed of.
