Transfer Civil Miscellaneous Petition filed under Section 24 of the Code of Civil Procedure, 1908 to withdraw the I.D.O.P. No.155 of 2019 from the file of Principal District Court, Salem and to transfer the same to the file of the Family Court, Dharmapuri.

The husband though served, has not chosen to appear before this Court either in person or through counsel duly instructed.
2. The wife seeks transfer of IDOP No.155 of 2019 from the file of the Principal District Court, Salem to Family Court, Dharmapuri.
3. The transfer is sought for solely on the ground of convenience of the wife who is a resident of Pappireddipatty in Dharmapuri District. If the proceedings are transferred to Family Court, it would be very difficult for the husband as he has to appear in person for every hearing before the Family Court which would cause great hardship to the husband. Considering the same and also the convenience of the wife who is a resident of Pappireddipatty, IDOP No.155 of 2019 is withdrawn from the file of the Principal District Court, Salem and https://hcservices.ecourts.gov.in/hcservices/
transferred to the Principal District Court, Dharmapuri to be tried and disposed of in accordance with law. The Transfer Civil Miscellaneous Petition is allowed accordingly. No costs.
