The learned counsel for the petitioner submits that the appeal dismissed as abated, in view of the demise of the sole appellant. The legal representatives have taken out an application to condone the delay of 265 days in filing the petition to set aside the order of abatement. Now the learned counsel for the petitioners reports that, the legal representatives of the sole appellant have not given him any instructions to pursue further, inspite of writing letters to one of the proposed petitioner by name Shanmugam. In the light of the above submissions, the CMP No.8877 of 2004 to set aside order of abatement is dismissed.
