(CRIME NO.5 OF 2021) Petition praying that in the circumstances stated therein the High Court will be pleased to direct the learned Judicial Magistrate, Thiruvarur to accept the sureties as directed by this Hon`ble Court in Crl.OP.No.12532 of 2021 dated 20.07.2021.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S. R.JAYAPRAKASH Advocate for the petitioner and of Mr.A.Gopinath, Government Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed to modify the condition imposed by this Court vide order dated 17.06.2021 in Crl.O.P.No.12532 of 2021, wherein, the petitioner was directed to deposit a sum of Rs.2,00,000/- to the credit of Cr.No. 5 of 2021 to the defacto complainant.

2. This court while granting Anticipatory bail to the petitioner vide order dated 20.07.2021 in Crl.O.P.No. 12532 of 2021 imposed a condition that the petitioner shall deposit a sum of Rs.2,00,000 to the credit of Crime No. 5 of 2021 and the same to be disbursed to the defacto complainant. However, the petitioner without depositing the said amount, had filed the sureties. Though it is claimed by the petitioner that time was given for four weeks to deposit the amount, it is to be pointed out that only on payment of the amount the sureties could be executed. The Learned Magistrate was rigid in referring to accept the sureties.

3. In view of the above position, this court is not inclined to allow this petition for modification as prayed for. However, time is extended by a period of two weeks from today for payment of the amount and thereafter seeks for execution of sureties is extended only to deposit the amount for a period of two weeks. -sd/- 07/09/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
