MURALIDARAN CRIMINAL MISCELLANEOUS PETITION No.2963 of 2018 IN CRL RC.536/2017 K.DEVARAJ [ PETITIONER ] Vs T.SRIMATHI [ RESPONDENT ] Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition to once in 3 months instead of once in month, his presence and sign before the learned X Metropolitan Magistrate, Egmore, Chennai on 04.04.2017 in CC NO.15245 of 2003, the condition imposed by this Honourable Court in Crl.R.C.No.536 of 2017 dated 04.04.2017 condition that the petitioner to report before the above said concerned court on the first working day of every month 10.30 a.m.
until further orders by this Honourable Court Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.L.BASKARAN, Advocate for the petitioner , the court made the following order:- Seeking to relax the condition already imposed by this Court in Crl.M.P.No.4755 of 2017 in Crl.R.C.No.536 of 2017 dated 04.04.2017, the petitioner is before this Court with this miscellaneous petition. 2.The learned counsel for the petitioner submitted that the petitioner is regularly complying with the conditions imposed by this Court and hence, the conditions may be relaxed.
3. The learned Government Advocate (Criminal Side) vehemently opposed the petition for relaxing the conditions imposed by this Court .
4. In view of the above, the condition already imposed on the petitioner by this Court is modified to the effect that the petitioner shall report before the trial Court once in a week i.e. first working day of the week at 10.30 a.m. until further orders. This miscellaneous petition is ordered accordingly.
