Respondents Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned additional levy notice dated 16.08.2018 issued by the 4th respondent and quash the same and consequently, direct the respondent to restore service connection No.066-018-171/IIIB to the petitioner's company at Door No.13, Rajeshwari Layout, SIPCOT, Hosur 635 126 within a time frame fixed by the Court.

ORDER

Against the provisional demand notice issued by the 4th respondent, the present writ petition has been filed.

2. Against the impugned demand notice, the petitioner is entitled to file his objection under Clause 19(3) of the Tamil Nadu Electricity Supply Code. On filing such objection, the concerned authority has to consider his objection and pass the final assessment order. Without submitting the objection, the petitioner cannot maintain the writ petition and the same is liable to be dismissed.

3. Accordingly, this writ petition is dismissed. However, the petitioner is directed to file his objection before the 2nd respondent/ the Superintending Engineer, within a period of four weeks from the date of receipt of a copy of this order. On filing such objection, the 2nd respondent is directed to conduct enquiry and pass final assessment order within a period of six weeks thereafter. No Costs. Consequently, connected miscellaneous petitions are closed.
