When the matter was taken up for hearing, the learned counsel appearing for the plaintiff filed a memo indicating that the plaintiff had settled the issue with the legal heirs of the defendant and would wish to withdraw the suit as settled out of Court.

2.Recording the aforesaid submission, the plaintiff is permitted to withdraw the suit as settled out of Court.

3.Registry is directed to re-fund the Court fee. In view of the withdrawal of the suit, the order dated 21.09.2022 made in Application No.3234 of 2022 shall stand revoked and the indicated application shall stand closed.
