Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Appeal No.392/2017on the file of the High Court, the High Court will be pleased to suspend the sentence imposed on the petitioner by the honble special judge/chief judicial magistrate, krihsnagiri district, krishnagiri, in special calendar case No.02 of 2010 dated 30.06.2017.
Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.Appeal No.392/2017 on the file of the High Court and upon hearing the arguments of M/S.V.RAJAMOHAN Advocate for the petitioner and of MR.R.RAVICHANDRAN Government Advocate[crl.side] on behalf of the Respondent the court made the following order:- Seeking to suspend the sentence imposed on the petitioner by the learned Special Judge/Chief Judicial Magistrate, Krishnagiri District, Krishnagiri in Special Calendar Case No.2 of 2010 dated 30.06.2017, the petitioner is before this Court with this petition.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents.
3. Earlier, on 13.07.2017, a learned Single Judge of this Court has granted interim suspension of sentence to the petitioner till 21.08.2017.
4.Today, the petitioner is present before this Court, as directed earlier. Having regard to the facts and circumstances of the case, this miscellaneous petition is allowed and the sentence passed by the learned Special Judge/Chief Judicial Magistrate, Krishnagiri District, Krishnagiri in Special Calendar Case No.2 of
2010 dated 30.06.2017, is suspended, on condition that the petitioner shall surrender before the trial Court within two weeks from the date of receipt of this order copy and execute a bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties each for a like sum to the satisfaction of the learned Chief Judicial Magistrate, Special Judge, Krishnagiri District, Krishnagiri. Further, the petitioner shall appear before the trial Court on every first working day of the month at 10.30 a.m., until further orders.
