ORDER
The complaint regarding missing of the petitioner's husband lodged in the year 2014 could not be proceed and therefore, the writ petition is filed for a direction to investigate the matter.
2.The learned Government Advocate (Crl.side) appearing for the respondent states that initially on receipt of the complaint, investigation was taken up but there was no lead whereabouts of the petitioner's husband. Still the complaint is open. Pursuant to the Court direction, FIR No.236 of 2023 been registered and the matter is under investigation as and when any lead obtained in the course of investigation, the same will be informed to the petitioner.
3.The learned counsel appearing for the petitioner submits that even after 9 years of the complaint, the police is not able to trace the husband of the petitioner nor they have given report about the investigation. 4.The grievance of the petitioner appears to be the failure of the police to give a report of non traceable, so that, she can not get a decree of civil dead and avail the benefits provided to destitute widows. For the said purpose, there must be proper investigation. Since the investigation so far conducted has not yielded any result, the respondent police is directed to
trace the whereabouts of the petitioner's husband recording the statement of the persons, who are likely to know about his presence for the past 7 years or more and file a report within a period of 60 days. In view of the above, the writ petition is disposed of. No costs.
