This Revision petition is filed aggrieved by the order of the learned Principal Sessions Judge, Chengalpattu in Crl.A.No.30 of 2014 dated 30.09.2017 in and by which the learned Principal Sessions Judge has allowed the appeal filed by the respondent as against the order of the confiscation.

2. The case of the prosecution in this case is that the petitioner was found to be having illegal stock of 2400 litres of diesel to be sold in higher price in the black market.

3. The trial Court considering the fact that the respondent was a Civil Contractor operating several vehicles; since the diesel pump is 10 Kilometres away from his place of business, the respondent has stored the diesel for the purpose of his own use and also considering the fact that there was no black market for sale of diesel in higher price, allowed the appeal. Against which, the present Revision is filed along with a petition to condone the delay of 94 days.

4. Now considering the efflux of time and the nature of orders passed in the order impugned in the Revision, I am of the view that at this stage,the delay of 94 days cannot be condoned by this Court.
