PRAYER: Original Petition filed for appointment of Guardian under Sections 3, 7 to 10 and 29 of Guardian Wards Acts 1890 read with Order XXI Rule 2 & 3 of O.S.Rules, prays that this Hon'ble Court may be pleased; a) to appoint the petitioner as guardian of the person and property of the minors 1)P.Sharan and 2) P.Yashvanth;

b) to permit the petitioner to claim the Group Insurance Fund in respect of the deceased U.Penchil Prasad from the Corporation of Chennai and permit to receive the benefits on behalf of the minors 1)P.Sharan and 2) P.Yashvanth as guardian;

c) to deposit the amount in the name of minors 1) P.Sharan and 2) P.Yashvanth; in any nationalized Bank.

d) and pass such further or other orders as this Hon'ble Court may deems fit and proper in the circumstances of the case and thus render justice. 1/4

ORDER

This Original Petition has been filed to appoint the petitioner as guardian of the person and property of the minors viz., P.Sharan and P.Yashvanth; to permit the petitioner to claim the Group Insurance Fund in respect of the deceased U.Penchil Prasad from the Corporation of Chennai and permit to receive the benefits on behalf of the minors as guardian; to deposit the amount in the name of minors in any nationalized Bank.

2. When the matter was taken up today, both the petitioner and the respondent was present in person. The respondent was identified by the Aadhar Card that had been produced by her. She had specifically submitted that she is the maternal grand mother of the minor children. She would submit that the petitioner is the paternal grand mother. She would not have any objections that the paternal grand mother/the petitioner being appointed as Guardian of the person and property of the minors. 2/4

In view of the admission made by the respondent, who appeared in person, the original petition is ordered on the following terms; (i)the petitioner is appointed as the guardian of the person and properties of the minors P.Sharan and P.Yashvanth, (ii)the petitioner is permitted to claim the Group Insurance Fund in respect of the deceased U.Penchil Prasad from the Corporation of Chennai, (iii) the petitioner is permitted to receive the benefits on behalf of the minors P.Sharan and P.Yashvanth, (iv) the claim amount shall be deposited in a fixed deposit of any Nationalised Bank which shall be renewed periodically till both the minors attain the age of majority.

(v) File before this Court the copy of the fixed deposit receipts within six months before the Assistant Registrar (Original Side-II) of this Court.
