PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the Respondents to issue permanent approval for General Purpose Rating Course with revised intake as 12 batches per year in conclusion of Petitioner Institutions Application No.100592 dated 11.06.2023.

O R D E R

Mr.C.Kulanthaivel, learned Senior Panel Counsel accepts notice for the respondents and is armed with instructions to enable a final disposal of this Writ Petition, even at the stage of admission.

2. The petitioner is a College of Engineering and Technology and seeks a mandamus directing the respondent to issue permanent approval for General Purpose Rating Course with revised intake as 12 batches per year.

3. The petitioner has, in fact, vide application bearing No.100592 dated 11.06.2023 sought issuance of permanent approval from the concerned authority. That application is presently under process. There had been a surpirse inspection conducted by Capt.Tapesh Ghosh, NS and R.R.Subba Rao, E&SS, Surveyors and 48 deficiencies were noticed that were duly notified to the petitioner for its attention and due action. The petitioner has also been

appearing before the authorities setting out its compliances to the deficiencies noted.

Vide order dated 21.05.2024 passed by the Director General of Shipping, Mumbai, a detailed order running to 15 pages, the authority concludes that the enhancement of existing courses will be considered after satisfactory verification of compliances submitted by the Institute and after they establish that the DGS orders/circulars have been adhered to.

5. The Court believes that there is nothing untoward in this approach. Since both parties are agreed on the position that the processing of the application is currently on-going, there is no need for intervention, except to fix the upper time limit within which such process will be completed. For this purpose, the parties agree that eight (8) weeks would suffice.

6. Hence, application of the petitioner bearing No.100592 dated 11.06.2023 will be processed in accordance with law and all applicable Rules and Regulations and a final view taken by the authority, either to accept or reject the same, the latter by way of a speaking order, within a period of eight

(8) weeks from date of receipt of a copy of this order. Needless to state, the principles of natural justice will be adhered to scrupuously as well.

7. With this, this Writ Petition and the connected Miscellaneous Petition are closed. No costs.
