Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for a Writ of Certiorarified Mandamus, to call for the records of the impugned
proceedings of 4th respondent vide its proceedings No. Nil dated 28.02.2019 and quash the same and consequently direct the respondents to issue necessary order of transfer from the 4th respondent branch and permit the petitioner to join as a direct agent in the CBO-07 (Code No.727), Chennai Divisional-II, Bombay Mutual Building, 3rd Floor, N.S.C. Bose Road, Chennai - 600 001 within the time frame as fixed by this Court. For Petitioner :

The order impugned in the Writ petition was passed by the 4th respondent refusing to accede to the request made by the petitioner for transfer of the LIC agency from the respondent No.4-Velacherry branch (CBO-30) to (CBO-07) Chennai-2 Division, 2.On a perusal of the records, it is noticed that the competent authority for the transfer LIC Agency held by the petitioner from one city branch to another city branch situated in different divisions, namely Division I and Division II Chennai, the fourth respondent herein. In the light of the above, issuance of writ of mandamus to the fourth respondent as sought for does not arise. As the petitioner has not approached the competent authority seeking
transfer of the agency in question, this Court is of the considered view that it would be appropriate to dispose of the writ petition granting liberty to the petitioner to submit appropriate application to the competent authority i.e. the Senior Divisional Manager/the Zonal Manager.
3.Accordingly, the Writ Petition is disposed of granting liberty to make appropriate application to the competent authority within a period of four weeks from the date of receipt of a copy of this order and in case the petitioner makes such an application within time, the appropriate authority shall consider the same and pass appropriate orders thereon as expeditiously as possible preferably within a period of six weeks from the date of receipt of the application from the petitioner seeking transfer from CBO-30 Division-I to CBO-07 Division-II and communicate the said order to the petitioner. 4.With the above direction, this Writ Petition is disposed of.
