PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondent to pass final orders in the disciplinary proceedings held into the Charge Memo No.Na.Ka.No.AD/7/48162/2021-22 dated 08.01.2022 without further delay as the entire process has already been completed. ORDER
With the consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself. 1/4
2. The limited prayer sought for in this writ petition is to direct the respondent to pass final orders in the disciplinary proceedings held into the Charge Memo No. Na.Ka.No.AD/7/48162/2021-22 dated 08.01.2022 without further delay.
3. According to the learned counsel for the petitioner enquiry has been conducted and he has given further explanation on 30.12.2022. Since almost six months have lapsed in submitting his further explanation, it would be appropriate to direct the disciplinary authority to pass final orders on the petitioner's further explanation within a stipulated time.
4. Accordingly, the respondent is directed to pass final orders in the disciplinary proceedings held in the Charge Memo No.Na.Ka.No.AD/7/48162/2021-22 dated 08.01.2022 on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
