ORDER
The petitioner has lodged a complaint before the Inspector of Police, Chintadripet Police Station, but, no action has been taken. Thereafter, he filed a petition before the learned XIV Metropolitan Magistrate, Egmore in Crl.M.P.No.1731 of 2025. By the order, dated 28.04.2025, the learned XIV Metropolitan Magistrate, Egmore directed the Inspector of Police, Chintadripet Police Station to conduct a detailed enquiry on the complaint of the petitioner and in the course of enquiry, if any material evidence is found, then, the Inspector of Police can proceed thereon and a report has to be filed before the Court as soon as possible. Thereafter, the petitioner has not been informed about the stage of investigation and hence, the present petition has been filed.

The contention of the petitioner is that he is a proprietor of M/s.VIS Informatics, engaged in the line of trading and all types of sales and repairs of computers, peripheral equipment and electronic goods. One A.Sathish Kumar, Procurement Manager, one Hema Malini, Sales Coordinator and D.Venkatesan, Sales Manager, all joined together and committed misappropriation, cheating to a tune of more than Rs.25,00,000/-. The petitioner had produced all the supporting documents, 2/5
but, they were not considered.

The learned Counsel for Government of Tamil Nadu (Criminal Side) for the respondents, today, has produced the CD file and informed that the Inspector has submitted the CD to the Commissioner of Police, Chennai Commissionerate, who had given an opinion that there are no sufficient documents and the complaint can be closed.
4. Though he says that this order has been passed on 11.06.2026, the petitioner has to be informed about the same very soonn. On perusal of the CD, it is seen that in this case, already, the Assistant Commissioner of Police, Egmore range, on 04.08.2023, on the perusal of the CD and the materials, had found that cognizable offence is made out. Hence, he recommended to register a case and investigate. This was approved by the Deputy Commissioner of Police, Triplicane district on 10.08.2023, but, for some reason, the file has been kept pending and thereafter, now citing the legal advisor, it has been closed, which is not proper. In view of the same, the recommendation of the legal advisor to the Commissioner is set aside. The Assistant Commissioner of Police, Egmore is directed to conduct investigation in this matter and as per the opinion already given, register a 3/5
case and investigate. The Inspector of Police, Chintadripet Police Station shall forthwith handover the case bundle to the Assistant Commissioner of Police, Egmore along with all documents.
