Seeking modification of the condition imposed on the petitioner vide order dated 22.04.2022 passed in Crl.A.No.157 of 2022, the present criminal miscellaneous petition has been filed.

2. This Court, by order dated 22.04.2022 in Crl.A.No.157 of 2022, granted bail to the petitioner on certain conditions, one of which is that, "10.(ii) (a) Suresh Rajan (A2) shall execute a bond for a sum of Rs.25,000/- with two sureties for a like sum each to the satisfaction of the Special Court. . (b) The two sureties shall be Suresh Rajan's (A2's) blood relatives and they shall affix their photographs and Left Thumb Impression in the surety bond and the Special Court may obtain a copy of their Aadhaar card or bank pass book and mobile numbers to ensure their identify."

2. The learned counsel appearing for the petitioner submitted that the petitioner's father and mother are no more and he has got only one elder brother named Unnikrishnan, S/o.Rajan. Other than the said Unnikrishnan, he has no other blood relatives. He would also submit that due to poverty, the 1/3

petitioner is unable to execute the bond for a sum of Rs.25,000/- and thereby he seeks for modification of the above conditions.

3. The learned Special Public Prosecutor for NIA Act Cases has no serious objection for allowing this petition.

4. Considering the submission made by the learned counsel appearing for the petitioner, the condition imposed as against the petitioner is modified to the effect that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each, out of whom one surety should be his elder brother for a like sum to the satisfaction of the learned Special Court under National Investigation Agency Act 2008 (Exclusive trial of Bomb Blast Cases, Poonamallee, Chennai) Chengalpattu.
