PRAYER:

Writ petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the first respondent forthwith to initiate appropriate action under Section 205(1) of the Tamil Nadu Panchayats Act, 1994 and remove the fourth respondent from the post of Madhur Village Panchayat President, Uthiramerur Taluk, Kancheepuram District in Pursuant to the petitioner's representation dated 01.12.2011 & 02.04.2012.

ORDER

This writ petition is filed by the Vice President of Madhur Village Panchayat, seeking direction to the first respondent to initiate proceedings against the President of the Panchayat under Section 205(1) of the Tamil Nadu Panchayat Act,1994 based on his representation dated 01.12.2011 and 02.04.2012.

2.Heard the learned counsel for the petitioner, the learned Special Government Pleader appearing for the respondents 1 and 2, the learned counsel for the third respondent and the learned counsel for the fourth respondent.

3.It is submitted that based on the representation of the Vice-President of Madhur Village Panchyat, the District Collector, Kancheepuram has passed orders against the President by taking away the cheque signing power. It is further submitted that the term of office of the President and Vice-President had already expired and hence, the prayer sought for in this writ petition has become infructuous.

4.Taking note of the facts of this case, this writ petition is dismissed as having become infructuous. No costs.
