ORDER : The Court Made the following order :- This is an anticipatory bail application. Petitioner apprehending arrest at the hands of the respondent police has moved this petition. According to the prosecution, the petitioner had illegally transported sand in bullock cart and he was caught and the cart was seized. Therefore, the complaint was given to take action against the petitioner for the offences punishable under Sections 430 and 379 of IPC.

2.According to the learned counsel for the petitioner, the petitioner had not involved in such illegal transportation of sand and he would further submit that he is ready and willing to file an affidavit and execute a bond before the respondent police that he will not indulge in any such illegal act in future also.

3. I have heard the learned Additional Public Prosecutor appearing for the respondent.

4. Considering the said submission made by both sides, this Court is inclined to pass the following order: (i) That the petitioner in the event of arrest shall be released on bail within a period of two weeks from the date of receipt of a copy of this order on condition that he shall execute a bond for a sum of Rs.25,000/-(Rupees twenty five thousand only) with two sureties each for a likesum to the satisfaction of the learned

District Munsif-cum-Judicial Magistrate, Thirukazhukundram and also file an affidavit before the respondent police that he would not indulge in any illegal sand transportation in future. (ii) and also the petitioner shall appear before the respondent police daily at 10.30 a.m until further orders. -sd/- 19/01/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
