Respondents Prayer: Petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the 1st respondent to consider the petitioner's representation dated 19.09.2023 and remove the encroachments made by the 3rd and 4th respondents in public road within a stipulated time.

ORDER

(Order of the Court was made by the Hon'ble Acting Chief Justice) Heard Mr.S.Veera Raghavan, learned counsel for M/s.G.Uma Maheswari, learned counsel for the petitioner; Mr.Karthik Jagannath, learned Government Advocate for the first respondent; Mr.P.Srinivas, learned Standing Counsel for the second respondent; and, Mr.N.R.R.Arun Natarajan, learned Special Government Pleader (HR & CE) for respondents 3 and 4.

2. Seeking removal of the encroachments made by respondents 3 and 4 on the public road in the junction of Kottarampalayam and

Nagalathu street and in the junction of Mullapalayam and Nagalathu street, Kancheepuram, the petitioner sent a representation dated 19.9.2023 to the respondent authorities. As the said representation did not evoke any response, the present writ petition is filed.

3. Considering the narrow scope of the prayer made in the writ petition, without expressing any opinion on the merits of the matter, we direct the respondent authorities to consider the representation dated 19.9.2023 sent by the petitioner on merits and in accordance with law and pass appropriate orders, after notice to all concerned, including respondents 3 and 4, within a period of eight weeks from the date of receipt of a copy of this order.

4. The writ petition is disposed of accordingly. There shall be no order as to costs.
