Sowbagyam v. Venda @ Saraswathi

C.M.P.No.19519 of 2021 in S.A.No.166 of 2020 R.SAKTHIVEL, J., This petition has been filed by the petitioner under Order XXII Rule 3 read with Section 151 of C.P.C praying to bring on record the legal heirs of the deceased first appellant.

2. Heard the learned counsel for the petitioner /appellant and the learned counsel for respondents.

3.The third petitioner has filed an affidavit filed in support of this petition, wherein it is stated that the first appellant, Sowbagyam passed away on 09.03.2021 leaving behind the appellants 2 and 3 and the proposed appellants 4 and 5 as her legal heirs.

4.Being satisfied with the reasons stated in the affidavit filed in support of this petition, this Court is inclined to allow this petition. Accordingly, this petition is allowed as prayed for.

5. The Registry is directed to carry out the necessary amendment in the second appeal and post the appeal under the caption "for admission" on 21.08.2024.
