Application No.2796 of 2020 P.T.ASHA, J.

This application is filed for extending the mandate of the Arbitral Tribunal. The original statutory period of 12 months had lapsed on 29.06.2018 and thereafter parties had consented for extension for a further period of six months, which ended on 14.01.2019. The applicant had temporarily shifted the office and the records were moved to the new office. In the said process, the bundles were misplaced and therefore the applicant was unable to take out the application in time.

2. The proceedings are at the stage of cross examination of the respondent's witness. The delay appears to be only on account of the papers being misplaced at the end of the applicant's counsel, as a result of which, steps could not be immediately taken out for extending the time. It is needless to state that it is also open to the respondent to take steps to extend the mandate of the Arbitrator which exercise has not been undertaken by the respondent.

3. Considering the stage at which the proceedings are now pending, there shall be an extension of the mandate of the Arbitral Tribunal by a further period of six months from the date of receipt of a copy of this Order. No costs.
