Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondent herein to complete the enquiry in his proceedings bearing Na.Ka.No.1685/10/AA1 dated 05.08.2011 within a stipulated time.

By consent, the writ petition is taken up for final disposal.

The petitioner claims that he is an ardent devotee and worshipper of Arulmighu Bathirakaliamman temple, situated at Kallukkadaimedu, Erode. According to him, one of the Hereditary Trustees, viz., Tmt.Sakunthala, was collecting donations for making golden armor for the Presiding Deity and misappropriated the sum collected by way of donation and in this regard, a representation for taking appropriate action, has also been sent to the respondent. Originally, the Audit Officer attached to the Hindu Religious and Charitable Endowment Department, Erode, had also given a report, stating that appropriate action may be initiated against the said Hereditary Trustee u/s.53 of the Tamil Nadu Hindu Religious and Charitable Endowment Act, 1959. The grievance expressed by the petitioner is that though six years had lapsed, no progress is taking place in the enquiry against the said Hereditary Trustee and hence, the petitioner came forward to file the present writ petition.

Mrs.Rita Chandrasekar, learned Special Government Pleader [HR&CE] who accepts notice on behalf of the respondent. This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the same, directs the respondent to complete the enquiry initiated against Tmt.Sakunthala / Hereditary Trustee by rotation, in accordance with law and pass final orders as expeditiously as possible and not later than eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to Mrs.Sakunthala.

The writ petition is disposed of with the above direction. No costs.
