Contempt Petition filed under Section 11 of the Contempt of Courts Act to punish the respondents for wilful disobedience of the order passed in W.P.No.29250 of 2017 dated 16.11.2017.

O R D E R

This Contempt Petition is filed complaining that the order passed in W.P.No.29250/2017 dated 16.11.2017 has not been complied with.

2. After hearing this matter on several occasions, this 1/3

Court, by order dated 05.11.2019 inclined to issue statutory notice to the respondents. Accordingly, the matter is listed today after effecting statutory notice. In response to such statutory notice, Mr.V.Muthuswamy, District Revenue officer, Tiruvallur and Ms.C.Vidya, Revenue Divisional Officer, Tiruvallur, are personally present before this Court.

Mr.M.Elumalai, learned Government Advocate appearing for the respondents submitted that the delay in complying with the order of this Court is neither willful nor wanton and he further submitted that by proceedings dated 29.11.2019, the order of this Curt has been complied with. He has also produced a copy of the said proceedings. Learned Government Advocate also submitted that he has handed over a cheque dated 29.11.2019 for a sum of Rs.39,909/- payable in the name of the petitioner and the receipt of the same is also acknowledged by the learned counsel for the petitioner.

4. Learned counsel for the petitioner submitted that the quantum of award is very meagre and therefore, the petitioner may be given liberty to agitate the matter against the quantum before the appropriate forum.

5. Needless to state that it is open to the petitioner to agitate the matter before the appropriate forum seeking for enhancement of compensation. However, since this Curt finds that the order passed by this Court has been complied 2/3

with, this Contempt Petition is closed granting liberty to the petitioner as stated supra.
