CRIME NO.222 OF 2020 For Petitioner : No Appearance For Respondent : MR.L.BASKARAN, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1) (aaa), 4(1-A) (ii) of TNP Act, r/w 6, 7 TNRS Rules, 2000 and 120(B) IPC in Crime No.222 of 2021,on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner was found in possession of 120 liters of ID Arrack. Hence, a case was registered against the petitioner.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and she has been falsely implicated in this case. He would also submit that this is the second anticipatory bail, earlier petition in Crl.O.P.No.9482 of 2021 was dismissed by this Court on 26.05.2021. Hence, he sought for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) would submit that the petitioner was found in possession of 120 litres of ID Arrack. He would also submit that she is having more than six cases which are all pending. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case that the petitioner is a habitual offender and there are more than six previous cases pending against her, and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed as no merits.
