S.Sumathy v. S.Annamalai And 4 Others
A.No.2946 of 2023 in CS.No.200 of 2020 R.N.MANJULA, J.
The learned counsel for the applicant submitted that in the particulars of the amendment as seen in the judges summons in A.No.2946/2023 there are some clerical errors and they have to be deleted and altered. A memo has been filed and in which the following two corrections are requested to be removed:
"(1) That the prayer in the amendment stated in para 17(1) at page No.7 has to be necessarily deleted since a similar prayer is already existing in the plaint.
(2) In page 8 of the Judges Summons the total value shown has been erroneously typed as Rs.1,13,000/- and same has to be corrected as Rs.1,00,13,000/- and the court fee payable is to be corrected as Rs.1,03,850/-."
2. On perusal, it is seen that one is for deletion and the other is to rectify a typographical error. Hence the memo is recorded and the plaintiff is allowed to carryout these corrections in the particulars of amendment as seen in the judge's summons.
