The relief sought for in the present writ petition is to direct the respondents to refund the EMD and Security Deposit amount to the petitioner, which was deposited for the contract made before the respondents.
2. The contractual obligations between the parties cannot be adjudicated in a writ proceedings and refund of security deposit or otherwise involves performance of contract between the parties with reference to the terms and conditions. https://hcservices.ecourts.gov.in/hcservices/
3. This being the factum, the petitioner has to approach the competent Court of Law for the purpose of adjudication of issues based on the documents and evidences and with reference to the terms and conditions of the contract. Thus, the writ petitioner is at liberty to approach the competent Court in the manner known to law.
4. With these observations, the writ petition stands disposed of. No costs.
