This miscellaneous petition is filed to condone the delay of 419 days in preferring the appeal.

Heard learned counsel for the parties.

Though this Court is not convinced with the reasons stated in the affidavit filed in support of this petition, in view of the settled position of law that when technical considerations are pitted against the cause for substantial justice, the cause for substantial justice has to be given greater weightage, we are inclined to condone the delay of 419 days in filing the appeal on condition that the petitioners shall pay a sum of Rs.2,000/- (Rupees Two Thousand only) to the first respondent/original writ petitioner, within one week from the date of receipt of copy of this order.

The miscellaneous petition is allowed subject to compliance of the aforesaid condition.
