This petition has been filed seeking to grant leave to file the above C.R.P.
2. Mr.M.Murali Vinodh, learned counsel for revision petitioner submitted that the issue between the parties in the M.V.Appeal No.13 of 2022 in respect of challenging the proceedings in R.No.27571/B1/2021, dated 29.03.2022, more particularly, restoration of the route plying between Pollachi Bus stand to Kattampatty. So, as a State Transport Corporation, he is necessary party to the proceedings, but he was purposely omitted to implead in the said proceedings. The learned counsel would also submit that without consulting the Revision Petitioner, the commencement of mofussil plying route cannot be granted. Hence, he is necessary party to the proceedings, but without adding the corporation as party, the entire proceedings is conducted. However, he is having valid defence to defend the case.
3. Considering the facts and circumstances and also considering the submissions of Revision Petitioner seems to be justifiable one, this Court is inclined to allow this petition and accordingly, this Civil Miscellaneous Petition is ordered.
