Crl.MP.No.7966/2019 in Crl.A.No.493/2009 A.D.JAGADISH CHANDIRA, J., The petition has been filed, seeking to recall the warrant dated 13.04.2019 issued in Crl.A.No.493/2009, against the petitioner/ appellant.
2.The petitioner/appellant is present before this Court, today.
3.Mr. A. Saravanan, the learned counsel appearing for the petitioner/appellant would submit that earlier Mr. P.M.Duraiswamy, the learned counsel was appearing for the petitioner/appellant and due to miscommunication, since the appellant was unable to give instructions, the earlier counsel had withdrawn his appearance. Further, since the appellant was not also aware of the hearing date, it resulted in his absence before this Court leading to issuance of Non-BailableWarrant. He would further submit that the petitioner/appellant has now instructed him to appear on his behalf and that he will be able to argue the case if sufficient time is granted to him and that he would also give an undertaking that the petitioner/appellant will appear before the Court without fail.
4.Taking into consideration the submissions made by the learned counsel for the petitioner, the absence of the petitioner before this Court on the earlier occasion is condoned and the Non Bail Warrant issued by this Court dated 13.04.2019 is recalled.
5.Post the main appeal on 03.07.2019.
The petitioner/appellant is directed to appear before this Court on that day without fail.
