O R D E R

The revision is filed by the wife, who is the respondent in a matrimonial proceedings in H.M.O.P.No.2536 of 2014, challenging the order in I.A.No.253 of 2016 permitting the husband to file a reply statement.

The main H.M.O.P. is filed by the husband seeking divorce. The revision petitioner-wife has filed her counter on 10.08.2015. It is stated that in the counter, besides denying the claim made by the respondent-husband, the wife has also raised unsatisfied allegations against the husband. Hence, the husband filed rejoinder to the same seeking leave of the Court.

The said application was resisted by the revision petitioner herein. However, that was allowed by the III Additional Family Court, Chennai.

The reply statement is only meeting the allegations put forth by the wife/the respondent in the O.P, which will form part of the pleadings. There is no impediment for receiving the reply statement. The argument of the learned counsel for the revision petitioner that the respondent-husband should have made all these statements even in the original petition is not sustainable, as the reply statement is only in response to the allegations put forth by the revision petitioner in the counter statement. Therefore, I do no not find any

infirmity in the order passed by the Court below and the revision deserves to be dismissed.

Accordingly, this Civil Revision Petition is dismissed. No costs. Consequently connected miscellaneous petition is closed. 23.12.2016 srn To The III Additional Family Court, Chennai.
