Transfer civil miscellaneous petition filed under Section 24 of C.P.C., seeking to withdraw HMOP.No.63 of 2021 pending on the file of the Sub-court, Kovilpatti and transfer the same to the Sub-Court, Ponneri.

O R D E R

The petitioner / wife seeks transfer of HMOP.No.63 of 2021 on the file of the Sub-Court, Kovilpatti to the Sub-Court, Ponneri. Transfer is sought for solely on the ground of convenience, since the wife is a resident of Manali New Town, Tiruvallur District.

2.Heard Mr.E.Udayachander, learned counsel appearing for the petitioner and Mr.Mayilvahana Rajendran, learned counsel appearing for the respondent.

3.Mr.Mayilvahana Rajendran, learned counsel appearing for the respondent would submit that the inconvenience caused to the husband, who is a resident of Kovilpatti will be less, if the HMOP is transferred to the Sub-court, Chengalpattu. The learned counsel appearing for the wife would submit that Ponneri is near to her place of residence than Chengalpattu.

4. Considering the overall circumstances, I am of the opinion that by transfer of the proceeding to Chengalpattu, the inconvenience caused to the husband will be reduced a little as he will be forced to travel at least 500 kilometres to the Subcourt, Chengalpattu. https://hcservices.ecourts.gov.in/hcservices/

5.In view of the above, HMOP.No.63 of 2021 pending on the file of the Sub-Court at Kovilpatti is withdrawn and transferred to the Sub-Court, Chengalpattu to be disposed of in accordance with law. This transfer civil miscellaneous petition is disposed of with the above directions. No costs. Consequently, connected miscellaneous petition is closed.
