Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the respondents to appoint the petitioner on compassionate ground in any of the post either in the revenue department or any other departments.

ORDER

The grievance of the petitioner in this case is that, her mother had sought for compassionate appointment of her within three years from the date of death of her father, who was a Village Assistant, who died in harness on 10.04.1991. In this regard, the petitioner has also made representation dated 23.09.2013, which is yet to be considered in spite of certification of the Revenue Divisional Officer that such application was made within three years from the date of death of her father. Hence, she came to file this writ petition seeking direction to the respondents to consider the petitioner's application for compassionate appointment. https://hcservices.ecourts.gov.in/hcservices/

2. The learned counsel appearing for the petitioner submits that direction be issued to the first respondent to consider the application of the petitioner for compassionate appointment in view of the certification of the Revenue Divisional Officer that the mother had applied, within the stipulated period.

3. The learned counsel for the State though has not filed counter affidavit, but submits that such application shall be examined and if the petitioner is found to be legally entitled to the same, necessary steps shall be taken in this regard.

4. Considering the aforesaid facts and submissions made, this Court dispose of this writ petition with a direction to the first respondent to look into the application of the petitioner for compassionate appointment and address the same in accordance with law, taking into consideration the certification of the Revenue Divisional Officer in this regard, if any, within a period of three months from the date of receipt of a copy of this Order. However, it is made clear that this Court has expressed no opinion on the merits of such representation / application of the petitioner in any manner. No costs.
