By consent, the writ petition is taken up for final disposal.
The petitioner claims to be a resident of Mathalambadi Village, Nookkambady Post, Tiruvannamalai Taluk and District and according to him, the land measuring to an extent of 4 acres 36 cents comprised in Survey No.115/A was assigned to one Subbrayan and the said land was resumed vide orders dated 28.11.1954 in K.Dis.No.3347/54 and once again, re-assigned in favour of Pudhural, Ammu Ammal and Chinnappa, vide proceedings of the Tahsildar, Tiruvannamalai and the land was divided into three parts and allotment was given in favour of the said Pudhural, Ammu Ammal and Chinnappa in Sub-Division Nos.115/3, 4 and 5. The petitioner would state that the above said three persons had an intention to offer their lands to Goddess Throwpathi Ammaon, the village Deity and however, Appavu Chettiyar has created and fabricated the documents as if the lands were inherited and in utter violations of the instructions and guidelines, had registered the documents by https://hcservices.ecourts.gov.in/hcservices/
practicing fraud in connivance with the revenue officials. In this regard, the villagers jointly submitted a representation dated 18.04.2016 to the 1st respondent and though it was acknowledged on 19.04.2016, no orders have been passed till date and therefore, the petitioner is constrained to approach this Court by filing the present writ petition. Heard the learned counsel for the petitioner and Mr.V.S.Ramesh, learned Government Advocate who accepts notice on behalf of the respondent.
Though the petitioner has prayed for a larger relief, this Court in the light of the facts and circumstances and without going into the merits of the claims projected by the petitioner either in the writ petition or in the representation, directs the 1st respondent to consider and dispose of the petitioner's representation dated 18.04.2016 on merits and in accordance with law, after putting on notice the person/s concerned and pass orders within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the person/s concerned.
The writ petition is disposed of with the above direction. No costs.
