This Criminal Original Petition is filed to direct the V Metropolitan Magistrate, Egmore, Chennai to complete the trial proceedings in C.C.No.4427 of 2016 as expeditiously as possible.

2. The Learned Counsel for the petitioner submits that for the offence committed in the year 2011, case was registered under Section 420 and 409 of I.P.C, later altered to 406, 506(i), 420 r/w 34 of I.P.C and final report filed in the year 2016. Even after lapse of 7 years, there is no progress except examination of P.W.1 and therefore, he has sought for above direction for speedy disposal of the case.

3. This Court, on perusing the record found that the case has been adjourned time to time for various reasons and therefore, called for report from the Presiding Officer. In his letter, he has explained why there was delay in completing the trial, particularly P.W.1 was examined in chief on 14.09.2022, not cross examined and presently the petition was filed under Section 311 of Cr.P.C., to recall the witness and same was allowed. Hence, the matter is 2/4

posted for P.W.1 cross on 30.07.2024. The Presiding Officer has also assured that he will speed up and dispose the case as early as possible.

4. In view of the above assurance given by the Presiding Officer, this Criminal Original Petition is disposed of, directing the V Metropolitan Magistrate, Egmore, Chennai, to complete the trial as expeditiously as possible. 25.07.2024 Index : Yes/No.
