ORDER
(Order of the Court was made by Dr.G.Jayachandran J.) The petitioner herein is the owner of the building bearing Door No.70, Secretariat Colony, 8th Street, Kilpaul, Chennai. Having constructed the said building without a valid planning approval, the petitioner is now facing action, including locking, sealing and demolition. The said communication is impugned in the present writ petition.
2.
The learned counsel appearing for the petitioner submitted that an application for the grant of planning approval, bearing No. LKCRV003 dated 17.03.2026, is pending before the authorities. She further submitted that an appeal before the Greater Chennai Corporation in COC/0743/24 is also pending. 3.
To verify the said facts, we called for an explanation from the Corporation. On perusal of the records, we find that the building permit application (LKCRV003) seeks approval for an additional second floor measuring 349 sq.ft., whereas a structure comprising ground plus three floors
already exists on the site. That apart, the appeal claimed to be pending does not pertain to the writ petitioner, but has been preferred by one Jenitha Paul Dass. 4.
When these facts were pointed out to the learned counsel for the petitioner, the counsel sought leave of this Court to withdraw the writ petition. Acceding to the said request, this writ petition is dismissed as withdrawn. Consequently, the connected Miscellaneous Petition is closed. No costs. (Dr.G.J.,J.)
