C.M.P. No.12861 of 2024 in C.M.A. No.1247 of 2020 ABDUL QUDDHOSE, J.

Learned counsel for the respondents 2 to 5 has stated no objection for allowing this petition, which has been filed to condone the delay of 43 days in filing the petition seeking to restore the order dated 22.12.2023 by which, the appeal was dismissed for non-prosecution as against R6 to R9.

2.This Court is satisfied with the reasons stated in the affidavit filed in support of this petition as sufficient cause has been shown.

3.Accordingly, this petition is allowed as prayed for. Registry is directed to number the petition filed by the petitioner seeking to restore the appeal, which was dismissed for nonprosecution as against R6 to R9 if the same is otherwise in order and list the same for hearing on 18.07.2024.
